I. Scope of application - contractual partners - definitions

1. These general terms and conditions apply to orders that customers place via the online shop: XLGRILL.STORE, Andreas Rudloff, St.-Wendelinus.Str. 8, 97509 Kolitzheim, Germany, phone: +49 (0) 177 1984971, e-mail: info@xlgrill.store.
2. Customers can be both consumers of legal age and entrepreneurs.
3. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession.
4. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, is acting in the exercise of their commercial or independent professional activity.

 II. Conclusion of contract - order process - corrections

1. The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
2. The customer can select products from our range in the online shop without obligation and collect them in a so-called virtual shopping basket using the ‘Add to basket’ button. The shopping basket can be called up at any time via the ‘Shopping basket’ button or the shopping basket symbol on the website. Within the shopping basket, the customer can change the product selection and also delete the product from the shopping basket. The customer can finalise the purchase by clicking on the ‘Check out’ button. If the customer already has a customer account, they can log in to their customer account, otherwise they can create a new customer account or order as a guest without a customer account. Before ordering, the customer is shown the shopping basket and the shipping address, the payment method and the shipping costs again. The customer can change the details by clicking on the individual order text or on the ‘Back to shopping basket’ link. By clicking the ‘Check out’ button, the customer submits a binding request to purchase the goods in the shopping basket in the online shop.
The seller then sends the customer an automatic confirmation of receipt by e-mail, in which the customer's order is listed again and which the customer can print out using the ‘Print’ function (order confirmation). This automatic confirmation of receipt merely documents that the customer's order has been received by the seller and does not constitute acceptance of the order.
3. A purchase contract is only concluded with an explicit order confirmation or dispatch of the goods within 3-7 working days after receipt of payment.
4. If payment in advance has been agreed for orders, the contract is concluded when the bank details and payment request are provided. If the advance payment has not been received by the seller within 10 calendar days after the request for payment has been sent, despite the due date, the seller shall withdraw from the contract with the consequence that the order shall lapse and the seller shall have no obligation to deliver. The order is then cancelled without further consequences for the buyer and the seller.
5. In the case of direct debit, the purchase contract is concluded upon collection.

III. Prices, Delivery and Shipping costs, Delivery time, Delivery area

1. We deliver throughout Germany, except islands. Neighbouring countries: Belgium, Bulgaria, France, Italy, Luxembourg, Netherlands, Austria, Poland, Portugal, Switzerland.
2. All prices are total prices in euros, including statutory VAT and all other price components plus any delivery and shipping costs, unless free delivery has been agreed.
3. The shipping costs for items up to 5kg are 4,95 € throughout Germany (excluding islands). Other countries 8,50 €. 
For items over 5kg Germany-wide 6,95 €, other countries 12,90 €. Free shipping (except islands) from 50 € purchase value.
Self-collection of the goods in Kolitzheim is possible by arrangement.
4. Unless otherwise stated in the item description, the goods will be delivered throughout Germany within 3-7 working days after conclusion of the contract. Delivery times to other countries may vary.
5. If payment in advance has been agreed, delivery will be made to the seller within 3-7 working days after receipt of payment, unless a different delivery time is specified for the item.
6. The goods are delivered throughout Europe (except islands).

IV. Return costs when exercising the right of cancellation

1. The customer shall bear the return costs when exercising the right of cancellation.

V. Storage of the contractual provisions

1. The contractual conditions and your order data are stored by us.
2. The following applies to online orders: After receipt of the order by us, the order data and the General Terms and Conditions are sent to the customer by e-mail. The customer can save this information in a reproducible form or print it out using his Internet browser.
3. Before sending the online order, the contract data can be printed out by the customer using the browser's print function or by pressing the Ctrl-P key combination or saved electronically by pressing the Ctrl-S key combination.
4. Registered online customers can view past orders in their customer account in our web shop.
5. In addition, the contract text is no longer accessible via the Internet for security reasons.

VI. Retention of title

1. The goods remain our property until full payment has been made.

VIII. Applicable law, place of jurisdiction, contract language

1. The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In the event that the customer is a consumer, this shall only apply insofar as the protection granted by mandatory provisions of the law of the state in which the consumer has his habitual residence is not withdrawn.
2. If the customer is a merchant, a legal entity under public law or a special fund under public law, or has no domestic place of jurisdiction, the exclusive place of jurisdiction for all disputes arising from this contract shall be the court of jurisdiction. We are also entitled to sue the customer at his general place of jurisdiction.
3. The contractual language is German.

IX. Reference to the EU dispute resolution platform and information in accordance with VSBG

1. The European Commission provides a platform for online dispute resolution (ODR platform). This gives consumers the opportunity to initially resolve disputes in connection with their online order out of court. The ODR platform can be accessed via the following link: https://ec.europa.eu/consumers/odr.
2. We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
